SUPREME COURT ALLOWS PASSIVE EUTHANASIA

In a landmark Judgment, Supreme Court of India legalised passive EUTHANASIA(GOOD DEATH) on March 9,2018. A five judge constitution bench headed by Chief Justice of India Dipak Misra said passive Euthanasia and advance living will are permissible.

Supreme Court has reversed their order given on 11 October,2017 saying Right to Die cannot be separated from Right to Life under Article 21 of the constitution.

Hearing to the PIL filed by the NGO Common Cause, Supreme Court added that safeguard are needed to be taken while withdrawing life support of a terminally ill patient.

Pinki Virani, also filed the petition in the Supreme Court on the behalf of Aruna Shanbaug, the nurse who was raped and is in the state of coma for last 40 years. Although in May 2017 the Supreme Court rejected the mercy killing of Aruna Shanbaug.

However, Right to Die can only be executed after the opinion of the medical board certifying the condition of the patient.
